OpereBem Ecosystem Terms of Use

These Terms govern access to OpereBem websites and use of its digital services.

Important summary

The Services are intended only for persons aged 18 or older. Content, market data and artificial intelligence features are informational, educational or organisational and may contain delays or errors. They are not investment recommendations and do not replace professional assessment.

By creating an account, purchasing a plan or continuing to use the Services after having access to these Terms, you confirm that you have read and accepted them. If you do not agree, do not use the Services.

1. Parties, purpose, scope and incorporated documents

1.1. OpereBem-branded websites, applications and services are operated by Mateus Teixeira, an individual, hereinafter “OpereBem”. A person who accesses or uses any part of the Ecosystem is a “User”. OpereBem and the User are collectively the “Parties”.

1.2. These Terms govern access to and the licence to use Terminal OpereBem, Portal OpereBem, Diário OpereBem, the Community, OpereBem ID, authorised APIs, courses, educational materials, institutional websites, help pages, documentation, status and other current or future features that refer to this agreement.

1.3. Provisions on accounts, subscriptions, payments, courses, certification, community or user content apply only where the relevant feature exists. The offer page, purchase summary, plan description and specific rules displayed in a Service supplement this agreement and bind the Parties.

1.4. The Privacy Policy governs personal data processing. The Risk Notice forms part of these Terms for financial-market-related matters. Community Rules, API terms and specific campaign or course conditions also apply when presented to the User.

2. Definitions

  • 2.1. Ecosystem: the integrated set of Sites, Services, content and channels operated under the OpereBem brand.
  • 2.2. Sites: OpereBem's institutional, commercial, documentation, help, status and other public pages.
  • 2.3. Services: digital products and authenticated environments, including Terminal, Portal, Diário, Community, OpereBem ID and official APIs.
  • 2.4. OpereBem Content: texts, news, analyses, reports, quotes, charts, images, videos, audio, classes, streams, code, software, interfaces and organised databases provided by OpereBem or its licensors.
  • 2.5. Educational Materials: courses, modules, recorded or live classes, live streams, workbooks, PDFs, e-books, presentations, spreadsheets, templates, checklists, exercises, assessments, case studies, recordings, indicators and supplementary materials offered through Portal or another Service.
  • 2.6. User Content: data, texts, images, files, trades, notes, comments, messages and other materials submitted or published by the User.
  • 2.7. Plan: FREE, PLUS, PRO or a future offering with the features, limits, price and billing interval displayed before purchase.
  • 2.8. Partner: a participant in a separate programme who shares authorised links or codes and has no power to represent or assume obligations for OpereBem.

3. Eligibility, contract formation and OpereBem ID

3.1. Only persons aged 18 or older who have legal capacity to contract may use the Services. Minors may not create accounts.

3.2. The contract is formed when the User creates an account, checks the acceptance box, purchases a Plan or uses a Service after having access to these Terms. The User confirms having had an opportunity to read, store and reproduce the document.

3.3. Users must provide accurate, current, personal and sufficient registration information and keep it updated. OpereBem may request reasonable identity confirmation to protect an account, prevent fraud or comply with a legal duty.

3.4. OpereBem ID is the single identity used throughout the Ecosystem. Accounts are personal and non-transferable. Users must protect passwords, codes, API keys and devices, refrain from sharing credentials and immediately report suspicious access.

3.5. Users are responsible for activities performed with their credentials where an act or omission was within their control. This does not exclude OpereBem's responsibility for security failures legally attributable to it.

4. Services, courses and Educational Materials

4.1. The Ecosystem combines market tools, trade organisation and tracking, informational content, education, community and support. Each Service has its own purpose and features described on its page or offer.

4.2. Courses and Educational Materials may be free, included in a Plan, sold separately, released by module, available for a stated period or subject to requirements disclosed in the offer.

4.3. Purchasing a course or Plan grants a personal licence to access the materials expressly included. It does not transfer authorship, economic rights, source files, resale or teaching rights, or lifetime access unless the offer expressly states otherwise.

4.4. Schedules, instructors, module order, supplementary materials, live-class times and delivery format may be adjusted for educational, technical or operational reasons while preserving the essential purpose and value of the offer.

4.5. Live classes may be recorded. Where a User's audio, video, name or message may appear, information will be provided in the environment. Featured use of their likeness, voice or testimonial outside the class context requires specific permission.

4.6. Certificates, where offered, may require minimum completion, assessments, attendance, an account in good standing or other disclosed criteria. A certificate confirms participation or completion, not professional qualification, regulatory registration, employment, profit or external accreditation.

4.7. Educational support, individual feedback, mentoring, closed groups, file downloads and future updates are included only when expressly stated in the offer.

5. Plans, offers and purchases

5.1. The Services may offer FREE, PLUS and PRO Plans with monthly or annual billing. Price, interval, features, limits, applicable taxes and promotional terms are displayed before purchase and form part of the contract.

5.2. Temporary benefits, bonuses, coupons, discounts and promotional access follow the applicable campaign conditions and term and do not permanently change a Plan.

5.3. OpereBem may add, remove or reorganise features. A material reduction to a current purchase will be notified reasonably in advance where possible. If a paid Service ends without an equivalent alternative, migration, credit or a proportional refund for the paid unused period will be offered as appropriate and required by law.

5.4. Partners only share authorised links or codes. They do not represent OpereBem, may not change an offer or assume obligations on its behalf. The Partner relationship is governed by a separate agreement.

6. Free trial, price, renewal and payment

6.1. Where offered to an eligible User, PRO includes a seven-day free trial that requires a card. PLUS has no free trial unless an offer expressly states otherwise.

6.2. At the end of the PRO trial, the subscription is charged and begins renewing automatically on the selected interval unless cancellation is completed before the trial ends. The applicable date and amount are shown at purchase.

6.3. Paid subscriptions renew automatically until cancelled. Price changes will be notified before affecting a future cycle, allowing the User to cancel renewal.

6.4. Payment is processed by a provider, currently Stripe. OpereBem does not store complete card details when processed by the provider. The User authorises attempts needed for the agreed charge and must maintain a valid payment method.

6.5. If the first charge after the trial fails, paid access may be blocked immediately. If a later renewal fails, a cure period of up to 14 days may apply; if the failure persists, the account returns to FREE. Further attempts and notices may occur during that period.

7. Cancellation, withdrawal and refunds

7.1. Cancellation must be requested through the Help Center, by ticket or WhatsApp through the listed channels.

  • 7.2. During the free trial: cancellation immediately ends PRO features and prevents the first charge if completed before the trial ends.
  • 7.3. After a charge: cancellation prevents the next renewal while paid access remains through the end of the purchased period.

7.4. Cancelling a subscription does not automatically close OpereBem ID or delete account data. Full account closure must be requested separately.

7.5. No additional commercial refund guarantee is provided. Mandatory consumer withdrawal and other statutory rights remain unaffected. A legally due refund will use the applicable method and may be subject to provider processing time.

8. Licence, User duties and prohibited conduct

8.1. OpereBem grants a limited, personal, revocable, non-exclusive, non-sublicensable and non-transferable licence to access what is included in the account or purchase solely for the User's own lawful use.

8.2. Users must comply with the law, these Terms, third-party rights, specific rules, technical limits and security guidance. Users must not:

  • a) share an account, password, session, key, paid Educational Materials or restricted access;
  • b) record, download where not authorised, systematically photograph, resell, publish, transmit, distribute or publicly display classes, streams, workbooks, PDFs, spreadsheets, templates or other OpereBem Content;
  • c) remove a trademark, attribution, protection, access control or source notice;
  • d) reverse engineer, bypass controls, test vulnerabilities without permission or interfere with security and availability;
  • e) use the Services for fraud, harassment, spam, rights violations, illegal activity, malware or malicious content;
  • f) reproduce methodology, structure or materials to create a competing product through substantial copying;
  • g) use scraping, crawling, bots, automated collection, data mining or similar means, including for non-commercial purposes.

8.3. Expressly enabled downloads may be kept for personal use during the applicable licence, without redistribution rights. End of access does not authorise new copies or exploitation of previously obtained files.

9. APIs, automation and scraping

9.1. Automated access to or extraction from the Ecosystem is prohibited. The sole exception is an officially provided API used within its current documentation, scope, purpose and limits.

9.2. The Diário API is read-only. Its key is personal, must remain confidential and may not be exposed, shared, resold, embedded in a third-party service without permission or used to bypass limits.

9.3. OpereBem may limit, rotate or revoke a key due to leakage, abuse, security risk, excessive requests or breach of these Terms, providing notice and a cure opportunity where the situation permits.

10. Intellectual property and User Content

10.1. OpereBem or its licensors' trademarks, software, interfaces, Educational Materials, texts, classes, reports, organised databases, visual elements and other OpereBem Content are protected by applicable law. No ownership right is transferred to the User.

10.2. Users retain rights in their Content and grant a technical licence limited to storing, processing, displaying, transmitting, protecting and making it available to operate the Service. It ends upon deletion, subject to temporary backups, legal duties, security and legal claims.

10.3. Content a User intentionally publishes in a public area or the Community may be reproduced by OpereBem to present or promote the Ecosystem with attribution appropriate to the context.

10.4. This permission does not include Diário data, tickets, private messages, private files or restricted areas. Featured use of name, likeness, voice or testimonial outside the original context requires specific permission.

10.5. Users confirm they hold all rights and permissions for submitted content. OpereBem may moderate or remove illegal, abusive, unsafe or non-compliant content.

11. Community, interactions and moderation

11.1. The Community is an educational and social environment subject to separate rules. Member content represents its authors and is not an OpereBem recommendation, validation or endorsement.

11.2. Users must not publish illegal, misleading, discriminatory, offensive, harassing, invasive, confidential, unauthorised protected or promotional content, or content capable of compromising another person's security.

11.3. A violation limited to community conduct may result in a warning, removal, restriction, suspension or ban from the Community only, without preventing other Services. The measure may be reviewed under Community Rules.

11.4. Fraud, security compromise, systemic abuse, illegal activity, account sharing or a violation affecting other products may result in action across OpereBem ID.

12. Financial education, market data and artificial intelligence

12.1. OpereBem Content, courses, classes, examples, demonstration trades and statements by instructors or members are informational and educational. They are not recommendations, offers, intermediation, financial, legal, tax or accounting advice, or promises of results.

12.2. Strategies, case studies, historical results and simulations do not guarantee future performance. Market activity involves risk, including total or, in specific circumstances, greater-than-allocated capital loss. Users are responsible for suitability, source checks and decisions.

12.3. Quotes, indicators, calendars and other data may be supplied by third parties and may be delayed, unavailable, incomplete or inaccurate. They must not be the sole basis for submitting, changing or cancelling orders.

12.4. Artificial-intelligence-assisted features are identified where applicable. AI output, such as interpretations of the Focus Bulletin, may summarise, infer or generate incorrect content and should be checked against original sources.

12.5. Diário and performance metrics are record-keeping and self-assessment tools. Discipline, satisfaction and anxiety fields are not medical or psychological diagnosis or care.

13. Third parties, links, integrations and Partners

13.1. The Services may rely on third-party hosting, payment, authentication, email, messaging, community, video, widgets, fonts, data and other resources subject to their own terms and policies.

13.2. A link, embed or mention does not automatically mean that OpereBem guarantees or is responsible for a third party's products, content, availability or independent conduct.

13.3. An integration enabled by the User may exchange data and may stop working due to a third-party change. OpereBem will use reasonable efforts to communicate material known impact.

13.4. Partners are limited to sharing authorised links and codes. A promise, discount or condition outside official channels binds OpereBem only if confirmed by it.

14. Availability, maintenance and evolution

14.1. Services are provided as available and have no service-level agreement (SLA) unless specifically agreed in writing. Maintenance, updates, failure, unavailability or temporary limitations may occur.

14.2. OpereBem may change interface, technology, sources, organisation, names and features to evolve or protect the Ecosystem without materially changing a current purchase.

14.3. Force majeure, widespread telecommunications failure, third-party attack, authority action or an event outside reasonable control may affect performance while the impediment continues, subject to mandatory rights.

14.4. Discontinuation of a paid Service will, where possible, include notice, migration and legally due proportional credit or refund.

15. Suspension, termination and effects

15.1. For a remediable violation, OpereBem will seek to state the reason and provide a reasonable opportunity to cure before suspending or terminating access.

15.2. Immediate action may be taken to contain fraud, security risk, abuse, illegal activity, access sharing, harm to third parties or infrastructure, serious intellectual-property infringement or an authority's order.

15.3. Voluntary account closure must be requested through the Help Center. After confirming identity and addressing pending matters, OpereBem will disable sessions, cancel renewals and delete or anonymise data no longer required. Users may request an export of available data before closure.

15.4. Financial, anti-fraud, security and legal-defence records may be retained within legal limits. Intellectual property, outstanding payments, liability, legal records and dispute resolution survive termination.

16. Warranties and liability

16.1. OpereBem will use efforts proportionate to its operation to deliver the offer, correct failures within its control and protect the Ecosystem. It does not guarantee uninterrupted availability, absolute absence of errors, compatibility with every device or educational, professional or financial outcomes.

16.2. To the fullest extent permitted by law, OpereBem is not liable for a User's investment decision, merely speculative profit, User-entered information, use contrary to these Terms or independent third-party acts outside reasonable control.

16.3. Users are responsible for damage caused by their unlawful conduct, third-party rights violation, intentional access sharing or unauthorised exploitation of materials, subject to due process and legal limits.

16.4. Nothing excludes mandatory consumer rights or liability for wilful misconduct, gross negligence, security failures attributable to OpereBem or matters that cannot be waived. Liability is assessed based on causation, each Party's contribution and proven damage.

17. Privacy and security

17.1. Personal data processing is governed by the Privacy Policy. Acceptance of these Terms does not replace specific consent where consent is the required legal basis.

17.2. Users must take reasonable care of devices, credentials and exported files. A suspected incident, vulnerability or unauthorised access must be reported immediately through the Help Center.

17.3. Users must not disclose a vulnerability before allowing reasonable analysis and remediation or conduct testing that compromises data, accounts, availability or third parties without written permission.

18. Changes, communications and general provisions

18.1. OpereBem may update these Terms for legal, technical or operational reasons. Version and effective date will be published here. Material changes will be notified appropriately and, where required, renewed acceptance will be requested. A User who disagrees may cancel before future effects.

18.2. Communications may be sent to the registered email, displayed in the Services or made available through the Help Center. Users must keep contact information current.

18.3. These Terms, incorporated documents and the applicable offer form the agreement on their subject. Failure to exercise a right is not a waiver. An invalid provision does not affect the rest and applies to the lawful extent possible.

18.4. Users may not transfer an account or contract without permission. OpereBem may transfer the operation to a successor that assumes obligations and preserves applicable rights, with notice where required.

18.5. Brazilian law applies, preserving the consumer's place of residence and any mandatory venue. PT and EN versions have the same meaning; Portuguese prevails in an unavoidable conflict.

19. Support

19.1. Questions, complaints, cancellations, withdrawal, account closure, data export and other requests must be submitted through the Terminal Help Center, by ticket or WhatsApp through the displayed channels.

19.2. To help locate the matter, Users should provide their OpereBem ID email and sufficient request details without sending a password, complete card data or broker credentials.
